Children

The Site is not directed at children 18 years of age and under. We do not knowingly collect, use, or share Personal Information from children 18 and under. Social Media

We are active on social media, including Facebook (now “Meta”), YouTube, TikTok, Twitter (now “X”), and Instagram (“Social Media”). Anything you post on Social Media is public information and will not be treated confidentially. We may post (or re-post) on the Site and our Social Media pages any comments or content that you post on our Social Media pages. Your use of Social Media is governed by the privacy policies and terms of the third parties that own and operate those websites and not by this Policy. We encourage you to review those policies and terms.

Third-Party Websites

The Site may link to, or be linked to, websites not maintained or controlled by Carmex. Carmex is not responsible for the privacy policies or practices of any third parties or any third-party websites. This Privacy Policy does not apply to any third-party websites or to any personal or other information that you may provide to third parties. You should read the privacy policy for each website that you visit.

Access from Outside the United States

If you access the Site from outside the United States, please be aware that Personal Information may be transferred to, stored in, and processed in the United States. Certain governmental authorities may not consider the level of protection of Personal Information in the United States to be equivalent to that required by the in other jurisdictions.

7. SECURITY MEASURES

We will take commercially reasonable security measures which we believe are appropriate to protect your Personal Information from loss, misuse, alteration, or destruction, and where possible, we will ask that any third parties to whom we may transfer your information take comparable steps to protect that security.

If a breach of your Personal Information occurs, we will notify you of the breach if required under applicable law.

How We Use Cookies and Web Beacons

We use Cookies when you visit and use our Site. A Cookie is a data file that is placed on your computer while you are visiting the website.  (“Cookies”) Web beacons / pixel tags are small graphics on a webpage that monitor your activity when viewing a webpage. These data files allow us to remember vital information that will improve your user experience. We may collect IP address, type of browser, operating system, and pages viewed by the user on our Site and other sites visited prior to ours using Cookies and web beacons.

A first-party Cookie allows your web browser to talk to the Site that you are visiting (i.e., this Site). A third-party Cookie allows your web browser to talk to a third-party provider providing services or features on our Site.

You cannot disable all Cookies, such as Cookies that are essential to the functioning of the Site. We describe below some of the tools we use on our Site to collect information, including Personal Information for Targeted Advertising and Analytics.  We also describe the features of those tools that allow you to limit the use of or opt-out of remarketing or analytics for those tools.

Analytics

  • Google Analytics We use Google Analytics to learn more about how visitors use our Site. To prevent this data from being used by Google Analytics, follow the instructions to download and install the Google Analytics opt-out browser add-on for each web browser you use. Using the Google Analytics opt-out browser add-on will not prevent us from using other analytics tools and will not prevent data from being sent to the Site itself or to Google. Opting out will not affect your use of the Site.   • Session Tracking: Crazy Egg. We use a third-party service, Crazy Egg, to analyze and improve the use of our pages. For more information about Crazy Egg’s privacy practices, please visit their Privacy Policy. Crazy Egg may use cookies for one or more of the following purposes: session tracking, user preference storage, A/B testing, usage pattern assessment, traffic analysis or advertisement performance assessment. Cookies placed by Crazy Egg do not include identifying information such as name, phone number, email address or mailing credentials.

When we implement and use Crazy Egg’s session tracking services, we collect information about how you navigate our Site including your browser and device information, IP address, date and time you visited the Site, and the duration of your visit, and your activity on our Site like mouse clicks, text form inputs, scrolls and swipes, loading spinners, pageviews, and Site errors. We use this information to improve our Site and to help you find information that you are looking for more efficiently on our Site. Advertising

  • Google Advertising Features. We have enabled and implemented the following Google Dynamic Remarketing and DoubleClick Floodlight on our Site to serve targeted advertising.   • TikTok Pixel. We have enabled the TikTok Pixel on the Site to measure and improve the performance of our advertising campaigns and to personalize user experience (including ads) on TikTok.

Marketing Communications; Opt Out

If you opt in to receive marketing communications from us, we may collect your name, email, and mailing address. We use this information to send you promotional and other electronic and hardcopy communications. We may use third-party providers to deliver communications to you. You may opt out of such emails by using the unsubscribe link in the email or contacting us at privacy@carmalabs.com with “Unsubscribe” in the subject line. Opting out of marketing communications does not opt you out of communications for other purposes such as customer service or return requests.

Who May Exercise Your California Privacy Rights. You may only make a request to exercise your California privacy rights on behalf of yourself. A parent or legal guardian may make a request on behalf of their child. A person that you authorize to act on your behalf may make a request related to your Personal Information. If you choose to use an authorized agent, you must (a) provide signed permission to that authorized agent to submit requests on your behalf, and (b) verify your identity. We may deny a request from an authorized agent if we do not have proof that they are authorized by you to act on your behalf.

Verifiable Consumer Request. To verify your request, you must provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information, and you must describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. To verify your identity, we may ask you to log into your account (if you have an account with us) or provide additional information. Any information you provide will only be used to verify your request. When seeking additional information from you, we may contact you through your account or the contact phone number or email address you provided in your request. If we cannot verify your identity, we may deny your request.

California residents may direct us not to sell or share your Personal Information at any time (this is your right to “opt out”).

If you are a California resident using an authorized agent to exercise your rights to opt out of the sale of Personal Information, you must (a) provide signed permission to that authorized agent to submit requests on your behalf, and (b) verify your identity. We may deny a request from an authorized agent if we do not have proof that they are authorized by you to act on your behalf. 

Right to Non-Discrimination

You have a right to not receive discriminatory treatment for exercising any of your rights under the CCPA. If we choose to offer a financial incentives program in the future, additional terms will apply which may be an exception to this Section.

Financial Incentive Offerings

We offer product samples, discounts, coupons, survey rewards and sweepstakes or contest rewards from time to time. In exchange, we will collect, use, share and retain certain Personal Information from you to deliver the benefit to you. We will also maintain and utilize the Personal Information you provide for future marketing purposes. These product samples, discounts, coupons, survey rewards and sweepstakes or contest rewards may be considered a financial incentive under CCPA. These financial incentives are reasonably related to the value of the data you provide.

We make a reasonable, good-faith determination of the estimated value of such information to our business, taking into consideration the value of the offer itself and the anticipated revenue generation from brand loyalty and repeat purchases. We calculate the value of the offer and financial incentive by using the expense related to the offer.

Shine the Light

Pursuant to California Civil Code Section 1798.83, if you are a California resident, you have the right to obtain: (a) a list of all third parties to whom we may have disclosed your Personal Information within the past year for direct marketing purposes, and (b) a description of the categories of Personal Information disclosed, by contacting us per the “Contact Us” Section above.
